These Terms of Service (“Terms”) govern your access to and use of the Real Estate ProTracker application, websites, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.​

1. Overview of Service

Real Estate ProTracker is a digital platform designed to assist real estate professionals with:

  • Client and transaction management

  • Task and document organization

  • Financial tracking and budgeting

  • AI-powered note-taking and summaries

  • Professional networking through an agent referral system

  • Tax record-keeping, mileage tracking, and estimated tax organization (the Tax Center)

  • Optional connections to your bank and credit card accounts to import transactions

The Service is intended as a productivity and organizational tool only.

2. Eligibility

You must be at least 18 years old to use the Service.

​

By using the Service, you represent that:

  • You have the legal capacity to enter into these Terms

  • You will comply with all applicable laws and regulations

3. Account Registration

To use certain features, you must create an account.

​

You agree to:

  • Provide accurate and complete information

  • Maintain the security of your login credentials

  • Notify us immediately of any unauthorized use

You are responsible for all activity under your account.

4. Subscription & Billing

4.1 Paid Features

Certain features of the Service require a paid subscription.

​

Subscription options may include:

  • Monthly plans

  • Annual plans​

Pricing is subject to change at any time.

4.2 Billing

By subscribing, you agree that:

  • Payments will be charged to your selected payment method

  • Subscriptions automatically renew unless canceled

  • You are responsible for all applicable taxes

4.3 Cancellation

You may cancel your subscription at any time.
Access to paid features will continue through the end of your billing period.

​

No refunds will be provided except where required by law.

​

4.4 Platform Billing

If you purchase through the Apple App Store or other third-party platforms:

  • Billing is managed by that platform

  • Refunds are subject to their policies

4.5 Team & Broker Plan Seats

The Team & Broker plan allows a subscribing broker to add agents to their team at no additional cost per seat.

Team seats are intended for real, actively practicing agents on the broker's actual team or brokerage roster.

We reserve the right to:

  • Request verification of an agent's license or affiliation

  • Review team composition for compliance with this intended use

  • Suspend or remove seats, team access, or Pro-level features granted through team membership if this section is violated

This does not affect the broker's own subscription, which remains governed by Sections 4.2 and 4.3 above.

5. No Professional Advice

The Service does not provide legal, financial, tax, or real estate advice.

​

Any:

  • Financial calculations

  • Budgeting tools

  • AI-generated summaries

  • Task recommendations

are for informational purposes only.

 

The Tax Center is a record-keeping and organization tool. Real Estate ProTracker does not prepare or file tax returns, does not provide tax, legal, or accounting advice, and is not a substitute for a qualified tax professional.

Tax estimates, suggested quarterly payments, deduction amounts, mileage deductions, Schedule C line suggestions, and similar figures are estimates based on the information you enter or import and on general published rates. They do not account for your full tax situation, such as other income, a spouse's income, credits, or state and local taxes. Tax rules and rates change, and we may not reflect every change immediately. You are solely responsible for your tax filings, payments, and decisions, and you should review them with a qualified tax professional.

We do not process tax payments. Payment links take you to the IRS or other government websites, and any payment you make there is between you and that agency.

 

You are solely responsible for consulting licensed professionals.

6. AI Features

The Service includes AI-powered features such as:

  • Audio transcription

  • Meeting summaries

  • Suggested action items

 

You acknowledge that:

  • AI outputs may be inaccurate or incomplete

  • AI content is not guaranteed to be reliable

  • You are responsible for reviewing and verifying all outputs

7. User Responsibilities

You agree that you will:

  • Use the Service only for lawful purposes

  • Maintain accurate records

  • Verify all data before relying on it

  • Comply with all real estate laws and regulations

 

Including, but not limited to:

  • Disclosure requirements

  • Brokerage rules

  • MLS regulations

  • Licensing laws

The Service does not guarantee compliance with any governing body, including the National Association of REALTORS.

8. Data & Content

8.1 Your Data

You retain ownership of all data you enter into the Service.

​

You grant us a limited license to:

  • Store

  • Process

  • Display

your data solely to provide the Service.

8.2 Data Accuracy

You are solely responsible for:

  • The accuracy of your data

  • Maintaining backups of your information

We are not responsible for lost or corrupted data.

9. Document Storage & Third-Party Services

The Service may integrate with or link to third-party services (e.g., cloud storage providers).

 

We:

  • Do not control third-party platforms

  • Are not responsible for their performance or security

  • Do not guarantee availability or uptime

Use of third-party services is at your own risk.

9.1 Bank Account Connections

If you connect a financial account, you authorize Real Estate ProTracker and our provider, Stripe, to access read-only information about that account, including its transactions, for the purposes described in our Privacy Policy. Your use of Stripe's service is also subject to Stripe's terms.

​

Transaction data comes from your financial institution through Stripe. We do not guarantee that it will be complete, accurate, or up to date, and connections may stop working if your bank changes its systems or your authorization expires. Review imported transactions and category suggestions before relying on them. Your bank statements remain the official record.

The number of accounts you can connect may be limited by your plan. We may change or discontinue this feature, and accounts are disconnected automatically if your paid plan ends.

9.2 Sharing with Tax Professionals

When you share your records with a tax professional through Real Estate ProTracker, you are responsible for choosing the recipient and providing the correct email address. Tax professionals, including any we partner with, are independent third parties, not our employees or agents. We are not responsible for their services or advice, and any engagement with them is between you and them.

9.3 Third-Party Offers

Real Estate ProTracker may display offers from third parties, such as business banking providers, and may receive compensation when you sign up through them. We do not endorse or guarantee any third-party product. Any account you open is governed solely by that provider's terms, and that provider, not Real Estate ProTracker, is responsible for its products and services.

10. Agent Referral Network

The Agent Referral Network is a professional networking feature.

 

We:

  • Do not verify agent licenses or credentials

  • Do not guarantee performance or outcomes

  • Are not responsible for agreements, referrals, or disputes

All arrangements are made independently between users.

11. Intellectual Property

All content, branding, and software associated with Real Estate ProTracker are the property of the company and are protected by intellectual property laws.

​

You may not:

  • Copy, modify, or distribute the Service

  • Reverse engineer the platform

  • Use the Service for unauthorized commercial purposes

12. Acceptable Use

You agree not to:

  • Use the Service for unlawful activities

  • Upload harmful or malicious content

  • Attempt to gain unauthorized access

  • Interfere with system functionality

We reserve the right to suspend or terminate accounts violating these Terms.

13. Availability & Modifications

We may:

  • Modify or discontinue features at any time

  • Update pricing

  • Perform maintenance that may interrupt access

We do not guarantee uninterrupted or error-free service.

14. Termination

We may suspend or terminate your access if:

  • You violate these Terms

  • You misuse the Service

  • Required by law

You may stop using the Service at any time.

15. Limitation of Liability

To the fullest extent permitted by law, Real Estate ProTracker shall not be liable for:

  • Loss of data

  • Lost profits or business opportunities

  • Missed deadlines or transaction errors

  • Reliance on AI-generated outputs

  • Taxes, penalties, or interest

  • Inaccurate tax estimates or deduction suggestions

  • Missed tax deadlines or reminders

  • Incomplete, delayed, or inaccurate bank transaction data

  • Services or advice from tax professionals or third-party partners

This includes indirect, incidental, or consequential damages.

16. Indemnification

You agree to indemnify and hold harmless Real Estate ProTracker from any claims, damages, or liabilities arising from:

  • Your use of the Service

  • Your violation of these Terms

  • Your professional activities

17. Governing Law

These Terms shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles.

18. Dispute Resolution

Any disputes arising under these Terms shall be resolved through:

  • Good-faith negotiation first

  • Then binding arbitration, where permitted by law

19. Changes to Terms

We may update these Terms at any time.

Continued use of the Service after updates constitutes acceptance of the revised Terms.
